How to Manage your Smart Visa and Beyond

1. Working condition for Smart Visa holder as well as spouse and children

In the following event, a Smart Visa holder must notify in written to the Smart Visa Unit by filling out Smart Visa Qualifications Update Form and e-mail to smartvisa@boi.go.th as soon as possible.

  • Changing of a position, job title, responsibility or assignment within the same company
  • Additional employment: Working for another endorsed company or employer or sponsor
  • Changing of companies in which Smart “I” holder has invested
  • Legal spouses of all Smart Visa holders and children of “Smart” T holders (18 years old of age or older) who wish to work.

Remarks:

1) Legal children of Smart “E” “I” and “S” holders wishing to work in Thailand must apply for a work permit at One Stop Service Center for Visa and Work Permit (OSS), following the criteria and regulations set by the Department of Employment.

2) The job must not be on prohibited list of occupations and professions for foreigners.

2. Smart visa extension

Smart Visa holders wishing to extend their permission to stay under Smart Visas must apply for a renewal of qualification endorsement at Smart Visa Extension at least 60 days before the expiry of Smart Visa.

After being notified of the result of qualification endorsement, the Smart visa holders must proceed with applying for Smart Visa extension at the Immigration Bureau at One Stop Service Center for Visa and Work Permit (OSS) , 18th Floor, Chamchuri Square Building, Bangkok before the expiry of Smart Visa.

Documents need to be presented at the time of Smart Visa extension are as follows.

The processing fee is 10,000 Baht per year of visa permission, for example the permitted duration of 1 year 4 months will cost 20,000 Baht and has to be paid to the Immigration at the time of visa extension.

3. Transferring a Smart Visa to a new passport

If you need to transfer a Smart Visa to a new passport, you must apply to have your Smart Visa transferred at the Immigration at One Stop Service Center for Visa and Work Permit (OSS). The required documents are as follows;

  • Transfer stamp to new passport form
  • Certificate from embassy (Original one only)
  • Copy of former passport with your photo
  • Copy of new passport with your photo
  • Copy of last arrival stamp in your passport
  • Copy of visa stamp in your passport
  • Copy of last extended visa in your passport
  • Copy of T.M. 6 Card
  • Copy of Smart Visa notification letter of qualification endorsement which is addressed to the Immigration Bureau
  • 1-Year notification card

4. Reporting requirements for Smart Visa holders

4.1) 1-year Reporting to the Immigration bureau at the One Stop Service Center for Visa and Work Permit

1. Smart Visa holders staying in Thailand for a period longer than 1 year consecutively are required to report the current address to the Immigration at One Stop Service Center for Visa and Work Permit (OSS) either in person, or by authorizing someone to report for you on your behalf. This report must be done on a yearly basis counting from Smart Visa issuance date (15 days before or 7 days after the date specified on 1-year report notification card). However, in the case of re-entering the Kingdom, the report will be due in 1 year from the date of the latest arrival.

The documents required to be submitted to the immigration are as follows.

  • TM.91 Form (completely filled out and signed)
  • Passport
  • T.M. 6 Card (arrival/departure card)
  • 1-Year report notification card (if any) *
  • T.M. 61 Form (For authorized person reporting on behalf of smart visa holder who lives in Bangkok)

* If Smart Visa is issued at Royal Thai Embassy/ Consulate-General, Smart Visa holders will not receive a 1-year report notification card. In such case, the report will be due in 1 year from the latest arrival date specified on the arrival stamp.

Remarks: Smart Visa extension is NOT considered the same as Smart Visa issuance. Therefore, even Smart Visa holders have recently extended their Smart Visa, they are still required to refer to the 1-year report notification card for the date of 1-year report (except in case of re-entering the Kingdom). For example, an extension from 6-month Smart “S” to 2-year Smart “S” does not mean that the 1-year report is due in 1 year from the Smart Visa extension date.

2. Alternatively, Smart Visa holders can report the current address to the Immigration via registered mail.

The documents required to be attached and sent to the immigration are as follows.

  • TM.91 Form (completely filled out and signed)
  • Copy of passport with the following pages.
    • - First page with passport holder's photo
      - Current visa stamp
      - Latest arrival stamp
      - Latest visa extension stamp
  • Copy of TM.6 card (arrival/departure card)
  • 1-Year report notification card (if any) *
  • An envelope with a 10 Baht stamp affixed. On the envelope, please write the return address in order for the officer to send back the lower part of TM.91 after having received the notification. This part must be kept for reference and for future notification of staying over 1 year.

* If Smart Visa is issued at Royal Thai Embassy/ Consulate-General, Smart Visa holders will not receive a 1-year report notification card. In such case, the report will be due in 1 year from the latest arrival date specified on the arrival stamp.

Your registered mail must be sent to the Immigration office at OSS in the following address and arrive during 7 days but not over 15 days before the due date of notification and the receipt of the registration must be kept for verification purposes.

4.2) Online 1-year Status Reporting to the Smart Visa Unit

In addition to the above 1-year reporting requirement, Smart Visa holders must SEPARATELY report their status and eligibility for Smart Visa to the Smart Visa Unit by filing STATUS REPORT FORM OF THE SMART VISA HOLDER with supporting documents and email to smartvisa@boi.go.th on a yearly basis counting from the issuance date of the notification letter.

The required documents are as follows.

  • All Smart Visa : STATUS REPORT FORM OF THE SMART VISA HOLDER
  • Smart “T” and “E” : Evidence of payment of annual income tax (such as PND91, PND90 or PND1 of the latest three months) or tax return documents (in case the income is paid by a company overseas).
  • Smart “I” and “S”: Copy of the list of shareholders (not more than 3 months old) or/and a transfer receipt of the capital investment.
  • Smart “S”: Foreign Business License or Foreign Business Certificate (in case of a foreign majority company in restricted business activities under the Foreign Business Act).

5. Smart Visa Termination

Procedures for Smart Visa cancellation/termination at One Stop Service Center for Visa and Work Permit (OSS) are as follows.

1. Smart Visa holder who would like to cancel or terminate Smart Visa before or on the expiry date of Smart Visa must notify in written to the Smart Visa Unit by filling out SMART VISA TERMINATION REQUEST FORM and email it together with supporting documents to smartvisa@boi.go.th as soon as possible. The supporting documents are as follows:

  • Termination letter of employment issued by the employer
  • Copy of Smart Visa stamp

2. Smart Visa holder will be notified via email once the notification letter of Smart Visa termination is ready. After being notified, Smart Visa holder is required to make an appointment via Smart Visa appointment booking system or smartvisa@boi.go.th (if the booking system is not available at the time) to schedule the date and time for Smart Visa termination at OSS center.

3. On the actual date, Smart Visa holder must arrive at the OSS center before the appointment time to collect the notification letter of Smart Visa termination from Smart Visa staff.

4. Smart Visa holder gets immigration documents and passport ready and then proceeds to the Immigration side.

5. Smart Visa holder has the Immigration’s information counter officer review the documents. After receiving the queue number, Smart Visa holder waits for the queue number to be called for the termination process at Counter no.15

6. After the Smart Visa termination, a foreigner is advised to leave the country or change to other types of visa before the end date of permission to stay in Thailand, as appeared on the termination stamp.

6. Procedures for Smart Visa holders who wish to obtain a personal driving license

The Department of Land Transport has established regulations for aliens applying for a driving license to submit work permit or proof of residence in the Kingdom issued by government agencies or foreign government agencies.

Therefore, Smart Visa holders wishing to obtain a personal driving license must provide proof of the current residence which can be obtained from

1. The Embassy or Consulate of their own nationality. For more information please contact the Embassy or Consulate of your nationality directly

or

2. The Immigration Bureau at One stop service center for visa and work permit (OSS), Chamchuri Square Building by applying for Residence Certificate and submit following documents in person;

  • COMPLETED APPLICATION FORM RESIDENCE CERTIFICATE IN THAILAND
  • The evidence of your residence. It could be either the receipt of TM.30 (notification to immigration that house-master, owner or the possessor notify you has stayed. the notification receipt through website or telephone are acceptable) or House lease agreement.
  • Passport
  • Copy of your passport (first page and visa page)
  • Copy of TM.6 card
