Guidelines for the request of a qualification endorsement of Smart “T”

Download and submit the form through our online system on our website www.smart-visa.boi.go.th/smart. The Smart Visa Unit will forward all application forms for the applicant to be endorsed in the targeted industry.
In addition to your company having to be endorsed for being engaged in the targeted industry; your company must also be endorsed as a startup or a startup enterprise. In order to be endorsed as a startup company, all paperwork related to the company will be sent to the National Innovation Agency (Public Organization) or NIA to be examined for a qualification endorsement.
It is not necessary to have a bachelor’s degree or higher. Applicants can use other types of educational backgrounds / qualifications, but has to be in connection to the field of science and technology, or have work experience in the related fields.
Education qualification which has to be from the field of science and technology and/or training certificates, awards, or evidence of work experience in connection to the applicant’s area of expertise will be examined.
There is no minimum income set for applicants with work contracts from government agencies. However, applicants must have evidence of employment contract or a letter endorsing the applicant’s expertise from the related government agencies.
Yes, Smart Visa holders can work in 2 companies. But both companies must pass a qualification endorsement as a targeted industry that Smart Visa has mentioned.
Yes they can still apply through considerations from work experience certificates, training certificates, research projects, or awards in connection to science and technology. This consideration is up to the discretion of the department in charge of endorsements.
You can apply for a Smart Visa but must specify that you were assigned to work in Thailand through a ‘Service agreement’ or a trade agreement between foreign companies and organizations in Thailand. The company must receive an endorsement in the targeted industry located in Thailand, in which foreigners come for work. In addition, you must also have an employment contract or employment certificate between the foreign company with an authorized signature included.
You can apply in advance if you have an exact date of when you’ll be starting work. You might be able to receive permission to request for a visa stamp before you start working.
You can apply under the category of Smart “T’, but must have expertise in the field of science and technology. Your work responsibilities must have connection to the area of expertise as well. This is to ensure that you are a real expert in that field when requesting for an endorsement.

Guidelines for the request of a qualification endorsement of Smart “E”

Yes you can, by downloading the application forms and submitting it online through our website www.smart-visa.boi.go.th/smart If your qualifications meet all the conditions, you do not need to wait for the expiration date of your original visa type to proceed to obtain a Smart “E”.
Yes you can do both. But both companies must be endorsed as a targeted industry that engages in technology-based manufacturing or provide services as mentioned by Smart Visa.
You must notify about the change of workplace and report to receive a stamp for the address of your new company.
Yes they can use it to apply, but the applicant must have their qualfication(s) translated into English or Thai language. They must also have a certificate from a trusted organization (such as embassies, governmental agencies, etc.) endorsing the equivalence of their education qualification.
If the appointed representative is the contact person mentioned on the application form, then they do not need to provide a letter of power of attorney. In the event of an online or paper-based application of qualification endorsement, the representative must provide a letter of power of attorney. The process of reporting oneself to the immigration to receive stamps must be done by the visa holder only. Contacting the immigration for other purposes such as moving the visa stamp from the old passport to the new passport can be done by issuing a letter of power of attorney (which must clearly specify the scope of the representative’s authority) to an appointed representative to file the matter for the Smart Visa holder.
Yes you can include them in your total. Since the condition is that your income is no less than 200,000 Baht per month for a Smart “E”; you can also include extra compensation and incentives such as bonus, accommodation rental allowance, and other benefits that can be calculated into amounts/number figures of money.
Yes you can proceed to apply. But you must have an official appointment letter from your company stating when your new position will become officially effective.
For large companies, you must hold at least an executive position in being the chief of operations or a higher position such as COO, CTO, EVP etc. For small-sized companies, you have to hold at least a senior management level with binding authority power such as M.D., CEO etc. This all depends on the appropriateness and discretion through considerations of the organizational chart of your company.
No, not all of them can apply. However, it depends on the size of your organization or company. In which the Smart Visa unit will be considering on the suitability of the maximum number of executives allowed to apply. Indications of consideration includes; the size of the organizational structure, organizational chart, total number of employees and etc.

Guidelines for the request of a qualification endorsement of Smart “I”

You must invest as an individual investor or through a venture captial company. The investment amount are as follows:
  • At least 20 milliom Baht in a technology-based business in manufacturing or service.
  • At least 5 million Baht in a startup or an incubator or accelerator program endorsed by relevant agencies. The investor can invest in more than 1 business, but must maintain the amount invested throughout the validity period of holding a Smart Visa.
It must be a technology-based business in the manufacturing or service field, and must be within the targeted industry set by Smart Visa, which are as follows:
  1. Next-Generation Automotive Industry
  2. Smart Electronics Industry
  3. Affluent, Medical and Wellness Tourism Industry
  4. Agriculture and Biotechnology Industry
  5. Food for the Future Industry
  6. Automation and Robotics Industry
  7. Aviation and Logistics Industry
  8. Biofuels and Biochemical Industry
  9. Digital Industry
  10. Medical Hub Industry
  11. Alternative Dispute Resolution Industry
  12. Human Resource Development in Science and Technology Industry
  13. Environmental Management and Renewable Energy Industry
The amount of money invested is just one of the qualifications for applicants of a Smart “I”. We will examine other information as well such as; whether the company invested is technonogy-based in manufacturing or service, in accordance to the rules set forth.
You cannot apply for a Smart Visa. You must invest in comapnies that are based in Thailand only.
In principle, the investment must be made under individuals’ names only. You cannot invest on behalf/under the name of a company. But if you can prove through documents that the investment is made through a company, and the name of the applicant is included in the list of shareholders, then you can apply but must calculate the true amount invested through methods that are comparable and proportional.
Yes you can. Apart from list of shareholders, you can also provide other documents such as the proof of bank transfer/investment transactions into the company’s bank account, etc.
Yes they can if they have proof of being a company/business owner based in foreign land, but is also a shareholder of a company based in Thailand and is requesting to be endorsed, they can then provide this in their application for a qualification endorsement.
Your company does not have to be promoted by the BOI. But it has to be a business located in Thailand, that is manufacturing-based or provide services.
The document cannot be older than 3 months, counting from the day that it has been transcribed.
You are eligible to apply for a Smart “T” if, it is an affiliate company based in Thailand, and has product developments or research and technology developments in Thailand

Guidelines for the request of a qualification endorsement of Smart “S” (6-month type visa)

Company establishment depends on many factors. The first factor is to see whether the business that you conduct appends with the Foreign Business Act or not. Foreigners can set up companies without needing to have a Thai partner, but they must request for a Foreign Business License (FBL) or a Foreign Business Certificate (FCT) in order for the operation of the business to run legally.
Yes you can apply for a 6-month type Smart “S” visa, but must also include the pitch deck of the initial business establishment plan. The plan has to show that your business is technology or innovation-based. You can submit the establishment plan through powerpoint slides or in other formats as well.
In the process of requesting for a qualification endorsement, Smart Visa will act as a central unit and coordinate with relevant endorsing units to endorse the business plan for you. The applicant does not have to submit a separate endorsement request for their business plan. After receiving results from relevant units, Smart Visa will be notifying on what to do next.
The pitch deck for startups must include important topics such as; layout of team members, background information and importance of business operations, purpose, target group, a model of the product/service, business plan in Thailand, business establishment plan in Thailand, revenue model, source of funds, etc. More details of establishment plans can be found at https://smart-visa.boi.go.th/smart/ click Once on the website, choose ‘Practical info’ and click ‘Documents Required’.
The processing fee for a Smart Visa is 10,000 Baht/year. Even though the processing fee has been paid and your 6-month type Smart “S” visa has been received, another 10,000 Baht must also be paid on the day you request for a visa.
Yes you can still apply. But once you become eligible to receive a Smart Visa, you must submit a proof of your health insurance that meets all required conditions. After submitting your health insurance documents, you will then receive a letter of endorsement which is needed for the visa.
Yes they can still apply. But they must provide a clear plan for the establishment of their startup company, where the business operation is technology or innovation-based. A clear plan of team expansion in the future must also be provided.
This depends on various factors such as whether you have stayed in Thailand for over 180 days or not, and whether you already have a tax ID or not. We recommend you to ask the revenue department for accuracy. But we assume that most 6-month type Smart “S” visa holders would still have not successfully establish their companies. Therefore, they still cannot pay salaries to themselves or their employees, and still do not have a tax ID number.

Guidelines for the request of a qualification endorsement of Smart “S” (1-year and 2-year type visa)

The 600,000 Baht deposit can come from a bank account from overseas or from Thailand as well. But the bank account must be held for at least 3 months.
Yes it can be shown under a stock account, but the account must be held for at least 3 months. However, you cannot use retirement fund or pension fund because you cannot withdraw money before the assigned date. Therefore, you cannot use these two accounts to conduct businesses in Thailand.
The details of incubation and accelerator programs and project coordinators are as follows, or you can also visit https://smart-visa.boi.go.th/smart and click ‘Practical info’, choose ‘Related documents’. The details will be under the ‘Other documents’ section.
After receiving a 1-year Smart “S”, the Smart Visa holder must successfully register and establish a company in Thailand in order to apply for a 2-year Smart “S” visa.
If the shares that you hold does not reach 25%, you cannot apply for a 2-year Smart “S” visa. You must increase the shares that you hold to no less than 25%, or have your name registered as the director of the company.
Agencies such as the National Innovation Agency (NIA) will be in charge of examining startup endorsement requests. Considerations will be made from the criterias of: innovation, technology and revenue scale up, where the proposed business plan or Pitch deck will carefully be examined.
In the event of applying for a 2-year Smart “S” visa, both can be possible. Thai people can be the majority shareholder, as well as foreigners.
Holders of 2-year Smart “S” visas can request to extend for another 2 years only if they are able to meet the original qualifications, criteria and conditions. Or they can also request for other types of visas such as Smart “T” or Smart “E”, if they meet all the requirements.
Startups that are based in other provinces can be included in the incubation and accelerator programs in Bangkok. But must be able to participate in various activities organized by each programs.
Applicants who wish to apply for a Smart “S” visa must personally apply themselves and participate in an incubation or accelerator program that are certified by the National Innovation Agency (NIA) or relevant government agencies. They can apply for a Smart Visa once they have received an acceptance for their request to participate in the program. Or they can also apply for a Smart Visa during the participation period or after it has ended. But it must happen within no less than 1 year’s time. Applicants must also provide documents of acceptance/confirmation from relevant programs

Guidelines for the request of a qualification endorsement of Smart “O”

Documents relating to evidence of family relationship must be in English or Thai language only. If the original documents are not in Thai or English language, then it must be translated and endorsed by trusted agencies. The original document must also be submitted along with the translated document.
No they cannot. The smart “O” criteria states that the dependant’s relationship must be legal spouse and children only. They must also submit document of evidence from the government as well.
No they cannot, as Thailand still does not have a law that recognizes same-sex marriage.
If they both applied at the same time, they will receive the same visa duration with the same expiry date as the main holders. But if the Smart “O” applicant applies afterwards or at a later date, they will still receive the same expiry date (but the total visa duration might not each the original duration as the main holder). E.g. If the main visa holder gets a 2-year visa, but the Smart “O” applicant applies at a later date, they will receive the same expiry date as the main visa holder, but the duration of the Smart “O” holder will be less than 2 years.
Dependants who are children must be under the age of 20 years old. But if the child is a dependant of a Smart “T” holder, and is still in school at the age of over 20 years old, they must also provide proof of receiving education.
The dependant can work in any industry they wish. But it must not be any of the occupations and professions prohibited for foreign workers listed by the Department of Labour.
The deposit of 180,000 Baht can be in either of the husband or wife’s bank account, and the bank account must be held for at least 3 months.
Yes they can apply for the child. But they must be able to provide evidence of family relationship, or official government documents such as court orders showing their rights to taking care of the child.
They must apply to receive a work permit stamp in their passport. They can do this by downloading the documents from www.smart-visa.boi.go.th/smart Click on ‘Practical Info’, choose ‘Download forms’ and choose ‘Smart Visa Qualifications Update Form’.
Depite being a dependant of a Smart Visa holder who has to submit a clearance certificate for a criminal background check, dependants do not have to submit a clearance certificate for a criminal background check.

Guidelines on notifying the results of qualification endorsements and facilitating the visa

  1. Notification of qualification endorsement of a Smart Visa, which is a document specifically for those who are eligible to receive a Smart Visa.
  2. A copy of the notification of qualification endorsement for those eligible to receive a Smart Visa from the Department of Consular Affairs.
  3. A copy of the notification of qualification endorsement for those eligible to receive a Smart Visa from the Immigration Bureau.
  1. A notification letter to the Immigration Bureau notifying the result of the qualification endorsement for those eligible to apply for a Smart Visa.
  2. TM 90 Form – Application for Smart Visa, along with a 4 x 6 cm. white background photograph of the applicant.
  3. STM6 Form – Criteria and Conditions Acknowledgement for the Temporary stay Permit in the Kingdom (Smart Visa).
  4. Acknowledgement Form of Terms and Conditions for Permit of Temporary stay in the Kingdom of Thailand (STM.)
  5. Acknowledgement Form of Penalties for a Visa Overstay.
  6. A certified true copy of the first page of passport, and a copy of all pages that contains arrival stamp.
  7. A certified true copy of TM.6 form (Departure Card).
60 days counting from the day of the result of qualification endorsement was notified. The notification of qualification endorsement will expire if it exceeds the period mentioned. It can no longer be used for the application of a Smart Visa. Eligible applicants must proceed to re-apply for a qualification endorsement again.
Presently they can apply for a visa at the following places: Department of Consular Affairs Division 3, Immigration Division 1, Center for Visa and Work Permit at Chamchuri Square Building, EEC Labour Administration Center, or Royal Thai Embassies/Royal Thai Consulate Generals overseas. (It must only be at the place where the eligible applicant has specified on the qualification endorsement application form)
  1. A letter to the Immigration Bureau notifying the termination of a foreigner’s employment. (The date of termination must be clearly specified. If the date is not specified, then the date of the issued letter will be considered instead). The letter must also be signed by authorized directors with binding power to the company or limited partnership.
  2. A copy of company registration certificate or limited partnetship . Copy of the registrar must not be older than 6 months.
  3. A copy of the latest month of witholding tax (P.N.D. 1) certified by a registrar from the Revenue Department.
  4. A certified true copy of the authorized directors with binding power to company’s national Thai ID card, or passport.
  5. Passport of the employment-terminated foreigner. (An officer will provide an employment termiantion stamp in the passport).
  6. Original version of the employment-terminated foreigner’s work permit.
They can inform the termination of their employment through the ‘Single Window for Visa and Work Permit’ system. They can do this 21 days ahead and can request for a Smart Visa stamp before the license period ends.
After resigning from their workplace, foreigners must return their work permit to the Office of Employment in their area within 15 days. They must also submit the following documents. (There is no penalty if they fail to return it within the specified number of days).
  1. Fill out, sign and make a copy of the Form for Work Permit Cancellation
  2. The original work permit
Presently, only cash can be used for paying the visa processing fee.
The Smart Visa unit will notify applicants through email. There will also be an attached file of either; ‘Notification of qualification endorsement of a smart visa’, or ‘Notification of refusal of qualification endorsement application for a Smart Visa’. Eligible applicants for Smart Visa (people who received a Notification of qualification endorsement of a Smart Visa) will have to proceed to request for a Smart Visa within 60 days counting from the day the notification was issued. If they are holding a Non-immigrant or other types of visas, they will have to proceed to cancel that visa first before being able to apply for a Smart Visa on the same day.
They must submit it before requesting for a Smart Visa. They can do this by providing their insurance policy or a receipt to prove that they have already purchased a health insurance policy, as well as attaching the benefits of the insurance policy.

Guidelines on services provided through the ‘Smart Visa Online Web Service’

The main steps are; A) creating an account in order to B) be able to submit an application form into the system
Creating an account to use the system contains the following procedures.
  1. Fill out the registration form on the Smart Visa website at https://smart-visa.boi.go.th/register.php
  2. Wait for the confirmation email and the link to activate through the email address you have provided in the registration form. The email should be in your inbox within 5 minutes after filling out the registration form. If the email does not show up in the inbox, please check in your Junk Mail.
  3. Click on the ‘Activate Link’ to confirm that it is the same email address that you have provided when filling out the registration form.
  4. After clicking the ‘Activate Link’, it will take you to a login page https://smart-visa.boi.go.th/signin.php
  5. Fill in your username and Password, click ‘Sign In’ to immediately enter to use the system
  1. Download the application file (file is in pdf format) according to your desired visa type that you would like to apply for.
  2. Fill in the details into the application form (the pdf file allows you to fill in the deails from your computer right away), and upload the PDF file back into the systen.
  3. After uploading all documents back into the system, the Smart Visa unit will examine all the documents. If all documents are completely correct, Smart Visa applicants will receive an answer for the qualification endorsement from the Smart Visa unit and related agencies within 3 working days. But if the documents are still incomplete, the Smart Visa unit will contact you for more documents and paperwork.
  4. Related agencies and units will notify the results/examine the application within 20 working days. If the related agencies and units still needs more documents/paperwork or more information, they will contact you back.
  1. Visit this website https://smart-visa.boi.go.th and click on ‘VISA ISSUANCE’.
  2. The very bottom of the webpage will contain a section called ‘Book your Smart Visa Appointment’. Fill in all the required information of the applicant wishing to make an appointment to issue their Smart Visa.
  3. The system will send you an email to the email address provided in the ‘Book your Smart Visa Appointment’ form.
  4. The email sent to you will contain information and details on the documents that you must prepare and bring on the day of your visa issuance. The documents required on the day of visa issuance will differ depending on the type of visa applied.
  5. Applicants must report to issue their visa on the requested date and time specified in the system. They must proceed to do this at the Smart Visa Unit, One Stop Service Center for Visa and Work Permit (OSS), Chamchuri Square Building, 18th floor, 319 Phayathai road, Pathumwan, Bangkok.
  1. After uploading all required documents specified in the system.
  2. The status in the system will automatically be updated as “Submitted”.
  3. A Smart Visa officer will proceed to examine all documents and will change the status to ‘Reviewing by BOI’.
  4. If the documents submitted are incorrect or invalid, the system will be updated as “Not Submitted”, and will notify the applicant to re-submit the documents once more.
  5. If the documents are all correct, your status in the system will change to “Processing”. This means that the Smart Visa unit has already issued the applicant’s document number, and is forwarding the documents to be processed.
Login to the system and click “Check Status” (on the left-hand side). The “Check Status” menu will provide all details (on the right hand side). You can check all the details such as; document number, name & surname of applicant, type of Smart Visa requested, your status in the system, last updated date in the system, or view the documents that you have uploaded in “Documents”.
You can check your status in the “Status” section. The details are as follows.
  • Not Submitted : You did not submit all required documents, or did not submit any documents into the system.
  • Submitted : You have submitted all required documents.
  • Reviewing by BOI : A Smart Visa officer is currently examining your documents.
  • Processing : A Smart Visa offider has forwarded your application to be processed and has issued a document number for your application.
  • Approved : You have been approved for a Smart Visa.
  • Not Approved : You have not been approved.
  • Uploading Additional Documents : The Smart Visa unit has contacted you through email requesting for more documents because the documents submitted prior are not enough.
  • Visa Received : You have already received your Smart Visa
The reason could be because:
  1. You did not successfully upload all the required documents.
  2. The uploaded documents did not meet the requirements, the file is too big (file size cannot be larger than 20MB) or not in the correct file formats allowed which are; PDF, JPG and PNG.
  • Incorrect/invalid email addresses or entering an email address already used to register into the system could be the reasons to why you were unable to register.
  • Conditions for creating a the password is as follows. The password must be in either Thai, English letters or numbers. You can also use both numbers and letters in Thai and English. When confirming your password, you must enter the same password that was written on the first time.
If it is not in your inbox, then please check your junk mail. If there is no verification email in both of these places, we recommend you to contact our staff for help through email or phone call to notify your issue.
  • Check whether you have clicked on the ‘Activation Link’ that was sent to you in the verfication email
  • Check whether you have written the same username and password that was provided during the registration process.
  • If you have done both of the above and is still unable to login, we recommend you to contact our staff for help through email or phone call to notify your issue.
Click on “Forgot Username & Password” on the login page and enter the same email address provided during the registration process. An email will be sent and you must click on the link in order to change your password. Enter your new password on the login page to enter the system. If you are still unable to login to the system, we recommend you to contact our staff through email or phone call to notify your issue.

Guidelines of considerations made from related agencies

The Smart Visa Unit will organize and coordinate the endorsement requsts for the applicants
Proof from the company such as production plan, website of company, porfolio, or other proof which shows that technology is mainly used in the business operations.
Your company must use those machineries and technologies to further develop, modify or improve in Thailand. If it has not been brought into Thailand to be further developed, modified or improved, then it cannot be used as a consideration factor that your company is technology-based.
If your company only imports products and provides services through installations and maintenance, then you are not eligible to apply for a Smart Visa.
In order to cosider whether your company is included in the targeted industry, proof of whether your company uses technology will be examined. As well as seeing whether the technology can create significant values.
Key characteristics of being a startup enterprise is examined from the ability to conduct new types of businesses that can grow by applying innovations and technology in its business operations. The NIA will endorse startup enterprises from these following criterias. -Innovation, -Technology and, -Revenue Scale Up. In addition, the Digital Economy Promotion Agency (depa) has its own definiton of a Digital Startup as well. The definition is: individuals, a group of people or small and medium enterprises that have/ have not registered under a Juristic person, having been operating in Thailand for no more than 5 years in businesses related to the digital industry which are; software development, hardware and smart device, digital services, digital content development, and communication equipment and services. In order for your company to be endorsed, both agencies will carefully look at the business plan or Pitch deck proposed by applicants.
Applicants of Smart “T”, “I”, “E”, and “S” who holds certain nationalities must submit a certificate of criminal background check. You can request to check for the list of nationalities that must submit these documents with the Smart Visa unit. All applicants of Smart “O” from all nationalities do not need to submit a certificate of criminal background check.
If you are a foreigner living abroad, you must contact relevant organizations in that country that are able to issue certificates of evidence of no criminal record such as from the police etc. If you are a foreigner living in Thailand, you can request to have your criminal background checked at the Criminal Record Registration Division, Royal Thai Police Headquarters.
The 27 occupations in accordance to the announcement from the Ministry of Labour dated on April 1st 2020 regarding to occupations that are strictly forbidden for foreigners are as follows:
  1. Wood Carving
  2. Driving motor vehicles or vehicles which do not use machinery or mechanical devices, except piloting aircrafts internationally or forklift driving jobs.
  3. Auction
  4. Grinding or polishing diamond and gemstones
  5. Haircutting, hairdressing, or beautification
  6. Cloth weaving by hand
  7. Mat weaving or making utensils from rattan, jute, hay, bamboo, grass plants, chicken feathers, cconut tree branch, fiber, wire or other materials.
  8. Making rice paper by hand
  9. Lacquer work
  10. Making Thai musical instruments
  11. Niello work
  12. Goldsmith, silversmith, or gold/copper alloy smith work.
  13. Stone work
  14. Making Thai dolls
  15. Making alms bowls
  16. Making silk products by hand
  17. Making Buddha images
  18. Making peper of cloth umbrellas
  19. Brokerage or agency except in internarional trading
  20. Thai massage
  21. Cigarette rolling by hand
  22. Tour guiding or conducting
  23. Hawking of goods
  24. Thai typesetting by hand
  25. Unwinding and twisting silk by hand
  26. Clerical or secretarial work
  27. Providing legal services or engaging in legal work, except for
  1. Arbitration work
  2. Work relating to defense of cases at arbitration level, provided the law governing the dispute under consideration by arbitrators is not Thai law, or it is a case where there is no need to apply for the enforcement of such arbitration award in Thailand.
There is no fee when applying for a qualification endorsement, but applicants must pay a processing fee of 10,000 Baht/year to the Immigration Bureau or Royal Thai Embassies/Royal Thai Consulate Generals when requesting for a visa.

Guidelines on consideration of status report

Smart Visa holders who are allowed to stay in the country for more than 1 year.
Download the form from the yearly status report notification email sent from an officer. Your 1-year stay in Thailand will be counted starting from the day you were issued the visa. Smart Visa holders can fill out the form and send it to smartvisa@boi.go.th along with any other additional documents. Smart Visa holders can do the status report 15 days before the due date or 7 days after the due date.
They are not the same thing. Status report is the yearly-based process of reporting your current status to the Smart Visa unit. This is to ensure that holders still meets the required conditions of having a Smart Visa. ‘Notification of residence’ is the process of notifying the address of your current residence to the Immigration Bureau. It is a mandatory process for those who have stayed in Thailand for more than 1consecutive year.
Smart T holders working in a private sector must provide proof of income or tax payment forms of either P.N.D.90 or P.N.D.91. This is to prove that your monthly income is in the criteria of 50,000 - 100,000 Baht per month. Smart T holders working in a governmental sector does not have to provide any extra documents, but would still need to complete the status report.
List of shareholders (not over 3 months old) and/or proof of transfering the investment money into the company.
Proof of income or tax payment forms of either P.N.D.90 or P.N.D. 91. This is to prove that your monthly income is in the criteria of 200,000 Baht per month.
List of shareholers (not over 3 months old) to prove that you hold 25% of the shares or, company certificate (not over 3 months old) from the Department of Business Development, to prove that you are the company director; and a Foreign Business Licence (in the event where foreigners hold majority of shares in the company).
If they are still a Smart Visa holder, then they must proceed to the Smart Visa unit to do the status report.
If the Smart Visa unit finds out that a Smart Visa holder did not proceed to do the status report on time, then the Smart Visa unit will check whether the visa holder still meets the qualification requirements. The Smart Visa unit will proceed to cancel the visa if the visa holder does not meet the qualification requirements.
The qualification will be considered as incomplete, therefore the Smart Visa holder must submit a termination request form, and proceed to cancel their Smart Visa.

Guidelines for requesting to change work details

The 3 cases where you must request to change your work details are as follows:
  1. Change of address/location of workplace
  2. Change of company name (but still using the same Juristic ID)
  3. Requesting for dependant (Smart O holder) to work
  • Smart Visa Qualifications update form
  • Document showing evidence of relocation/address of workplace
  • Copy of passport
After reviewing all submitted documents, the Smart Visa Unit will forward this to the Department of Employment to make sure and endorse that it is not a prohibited occupation for foreigners.
A certificate from the Department of Business Development, Ministry of Commerce.
Submit a ‘Smart Visa Qualifications Update Form’ which can be downloaded from https://smart-visa.boi.go.th/ Fill in all the details and email it to smartvisa@boi.go.th along with attachments of supporting documents, which are as follows.
  1. Company registration certificate from the Department of Business Development
  2. copy of employment certificate or employment contract
  3. copy of passport
Once the Department of Employment endorses that it is not a prohibited occupation for foreigners, the dependant will receive a request for company stamp form as well as receiving regulations and information on the procedures through email. Information on procedures such as; documents needed to submit along with the request for company stamp form will be provided. The documents must be submitted at the Center for Visa and Work Permit at Chamchuri Square Building on the next appointment date.
The following cases where foreigners are allowed to authorize others by issuing an authorization letter/letter of power of attorney along with the signature of the Smart Visa holder, are as follows:
  1. The case of changing address/location of workplace and changing the company’s name (using the same juristic ID number)
  2. The event where a dependant (Smart “O” visa holder) requests to notify additional work
Procedures for requesting a stamp by people with authorization are as follows:
Once the notification of request and information on regulations and procedures has been received through the Smart Visa holder’s email, the representative must come to the Smart Visa unit to collect a letter notifying the immigration office. They must be able to provide their signature when receiving the document as well as a letter of authorization/letter of power of attorney from the Smart Visa holder. They will then have to proceed to submit all documents (including passport) to an immigration officer in order to receive a stamp for the company address, or change the existing stamp depending on the case.
Note:
In the event of requesting for a Smart Visa stamp or requesting to extend the Smart Visa. Visa holders must complete these procedures themselves. They cannot give authorization to others to complete these steps for them.
If you have changed or moved address of your private residence, you do not need to inform the Smart Visa unit.

It will take about 7 working days for changing the name and/or address/location of workplace, and it will take about 14 working days for dependants requesting to inform additional work.
If the company’s name and juristic ID has been changed, the foreigner must re-apply for a new qualification endorsement. They must also proceed to terminate themselves from the old company in order to be able to work for the new company (which has to also be endorsed).

Guidelines on requesting to cancel Smart Visa

  • The Smart Visa Unit’s required documents for the cancellation are:
    1. Smart Visa Termination Request Form
    2. Termination of employment form
    3. Copy of Passport
  • The Immigration Bureau’s required documents for the cencellation are:
    1. Passport of those wishing to cancel
    2. Letter of Authorization (In the event where the Smart Visa holder is unable to complete this process themselves, a representative must provide a letter of authorization/letter of power of attorney in order to proceed).
The Smart Visa holder can issue a letter of authorization/letter of power of attorney to a representative. The representative must contact the Smart Visa unit with their passport and the letter of authorization/letter of power of attorney.
After receiving relevant documents from the Smart Visa unit, you can request for a cancellation stamp at the Immigration Bureau on the same day.
The dependants’ visas will not automatically be cancelled. Likewise to the main Smart Visa holder, dependants must also proceed to cancel their Smart Visa.
They don’t need to cancel their Smart Visa. But they must file the matter with the Smart Visa unit to request to change their personal information and receive a stamp for the new address.
  1. Resignation or termination of your current occupation position in your company or organization.
  2. Qualifications no longer meets the criteria
  3. Intending to move out of Thailand
  4. Wishing to change your Smart Visa to other different types of visa which are Non-B and Non-O. Both of which are under the investment promotion program
  5. Dependants (Smart O) of primary holders whose visa priviledges have been terminated according to circumstance no.1 and no.3
Those wishing to cancel their Smart Visa can proceed to notify the cancellation no later than 21 days before their last day of work.
We recommend Smart Visa holders to apply for the new type of their desired Smart Visa first. This is so that relevant units and agencies can examine considerations of endorsements. After being notified of the result of qualification endorsement, they should proceed to cancel their existing visa and request for a stamp of their new visa on the same day.
There is no charge and fee for the process of cancelling a Smart Visa.

Guidelines for requesting to remain in the Kingdom under a Smart Visa

The process of requesting to continually remain in the Kingdom under a Smart Visa is mainly based on the announcement no. 12/2561 from the BOI under the topic of qualification criteria, qualifications and conditions for temporary Smart Visa issuance. In which certain documents may be excluded when requesting. This is because we already have some information in our database when you were given a qualification endorsement. You may also not need to apply for a qualification endorsement in certain cases such as your area of expertise etc. Required documents (with details) when requesting to continually remain in the Kingdom are as follows:

2. Employment Contract Only for those working in Thailand.

  • You must be a recipient with an endorsed startup establishment plan. The business operation of your startup in Thailand must be technology or innovation-based, or engage in activities promoting startup businesses similar to Startup Camp by NIA depa.
  • You must have progress in establishing your business in Thailand, and be able to provide proof which are as follows; form for reserving juristic person’s name and memorandum of association. You will be able to extend your visa for another 6 months if you weren’t unable to set up your company in time (where you must hold at least 25% of the registered capital in your company). If you are a director of a company and have already established your company, you then will be allowed for a 2-year extension.
  • You must have health insurance throughout the period of your stay in Thailand, covering medical expenses for illness and accidents of at least 500,000 Baht.
6-month type holders of Smart S can request to extend for the same visa 1 extra time only. After that, they must extend to become a 2-year holder of Smart S. They can then request to extend the 2-year type visa for an unlimited number of times.
The 5 required documents are as follows.
  1. TM7 Form – Application for extension of temporary stay in the Kingdom
  2. TM8 Form – Acknowledgement of Terms and Conditions for Permit of Temporary stay in the Kingdom of Thailand
  3. Passport or travel document and a copy passport or travel document
  4. Notification letter from the Board of Investment to the Immigration Bureau within 60 days from issuance date of the endorsement letter
  5. STM6 Form – Criteria and Conditions Acknowledgement Form for the Temporary Stay Permit in the Kingdom (Smart Visa)

Legal spouse and children of Smart S (1 to 2-year type visas) holders would still need to provide financial proof of having at least 180,000 Baht deposit in the bank for at least 3 months.
The Smart Visa unit will have to re-examine the qualification endorsement of the applicant. The applicant will have to re-submit all documents again and it be the same process as requesting for a qualification endorsement on the first time. Notification of result will occur within 30 working days.
At least 60 days before the current visa is expired, because it takes 30 working days for relevant departments to issue a qualification endorsement. Applicants must request for a qualification endorsement in order to extend their Smart Visa along with providing documents which can be downloaded from our website https://smart-visa.boi.go.th/
Yes you can, but you must leave Thailand and re-enter with other types of visa. In the event of overstaying your visa, the penalties are as follows.

1) In the event where an Alien surrenders:

  1. Aliens overstaying in the Kingdom (counting from the visa expiration date) must pay a fine of 500 Baht/day but not excceeding 20,000 Baht at the immigration. The fine must first be paid before receiving a stamp for the visa extension or being able to leave the Kingdom of Thailand.
  2. Aliens overstaying in the Kindgom (counting from the visa expiration date) for over 90 days will be forbidden to re-enter the Kingdom for 1 year starting from the day the Alien departs out of the Kingdom.
  3. Aliens overstaying in the Kingdom (counting from the visa expiration date) for 1 year will be forbidden to re-enter the Kingdom for 3 years starting from the day the Alien departs out of the Kingdom.
  4. Aliens overstaying in the Kingdom (counting from the visa expiration date) for more than 3 years will be forbidden to re-enter the Kingdom for 5 years starting from the day the Alien departs out of the Kingdom.
  5. Aliens overstaying in the Kingdom (counting from the visa expiration date) for more than 5 years will be forbidden to re-enter the Kingdom for 10 years starting from the day the Alien departs ouf of the Kingdom

2) In the event where an Alien has been arrested and prosecuted

  1. Aliens overstaying in the Kingdom (counting from the visa expiration date) for less than 1 year will be forbidden to re-enter the Kingdom for 5 years starting from the say the Alien departs out of the Kingtom.
  2. Aliens overstaying in the Kingdom (counting from the visa expiration date) for over 1 year will be forbidden to re-enter the Kingdom for 10 years starting from the day the Alien departs out ouf the Kingdom.
10,000 Baht per person per year. In the event of having a dependant(s), the same fee rate applies.
